Anthropic Sues Pentagon While Launching New Think Tank
Anthropic has taken aggressive legal action against the Trump administration while simultaneously announcing a new research initiative to study AI's societal impacts. On March 9, 2026, the AI company filed lawsuits against the Pentagon and over a dozen federal agencies, challenging its designation as a "supply chain risk" as unlawful retaliation for refusing to lift safety restrictions on its Claude model.
The dispute stems from Anthropic's refusal to remove two "red lines" on Claude: prohibiting use for mass surveillance on Americans and fully autonomous weapons. The Pentagon demanded "all lawful use" of the AI model, and when Anthropic refused, the Defense Department designated the company as a supply chain risk on March 4, 2026, ordering a six-month phaseout from government systems.
"This action violates our First Amendment rights by punishing protected speech on AI policy," Anthropic's lawsuit states. The company argues the designation exceeds authority under federal law and lacks any evidence of actual security risks. The designation, typically reserved for foreign adversaries, has never before been applied to a U.S. company over policy disagreements.
The legal battle has drawn unexpected allies. Microsoft and retired military chiefs have filed briefs supporting Anthropic, arguing the Pentagon's actions set a dangerous precedent for the tech industry. Meanwhile, the U.S. military continues using Claude for operations including intelligence processing related to the ongoing Iran conflict.
Two days after filing suit, Anthropic announced the Anthropic Institute, a new internal think tank led by co-founder Jack Clark as Head of Public Benefit. The institute consolidates three existing research teams examining AI's frontier capabilities, societal impacts, and economic effects on employment. Founding members include economists and legal scholars tasked with producing candid research on AI risks.
"We face urgent challenges from rapid AI advances," Clark wrote announcing the initiative. "This institute will produce research that engages directly with affected workers and communities."
